1. Introduction

Welcome to Recruty Ltd ("Company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our services, including but not limited to Curriculum Vitae (CV) Review, CV Writing, Job Portal Account Creation, Job Applications Assistance, Cover Letter Writing, Career Guidance, Job Securing Assistance, and Interview Preparation (collectively, the "Services"). By engaging with our Services, you ("Client", "you", or "your") agree to be bound by these Terms.

2. Services

2.1 Scope of Services: Recruty Ltd provides professional recruitment support services. The specific nature and scope of the Services will be agreed upon in writing prior to commencement.

2.2 Service Delivery: We shall use reasonable efforts to deliver the Services within agreed timelines. However, all dates are estimates and not guarantees.

3. Client Obligations

3.1 Accurate Information: The Client warrants that all information provided is accurate, complete, and up-to-date. Any changes to such information must be communicated promptly.

3.2 Cooperation: The Client agrees to provide necessary materials, information, and access to facilitate the provision of Services.

4. Fees and Payment

4.1 Fees: All fees shall be as agreed upon in writing. Fees are exclusive of applicable taxes unless otherwise stated.

4.2 Payment Terms: Payment is due upon receipt of invoice unless alternative arrangements have been made in writing. Recruty Ltd reserves the right to suspend Services for delayed payments.

5. Confidentiality and Data Protection

5.1 Confidentiality: Both parties agree to maintain confidentiality regarding business, clients, and personal information, except as required by law.

5.2 Data Protection: Our handling of personal data complies with the UK General Data Protection Regulation (GDPR) and our Privacy Policy, which is incorporated herein by reference.

6. Intellectual Property Rights

6.1 Ownership: The Client retains ownership of materials provided to Recruty Ltd. Materials created by Recruty Ltd remain our property until full payment is received.

6.2 License: Upon full payment, Recruty Ltd grants the Client a non-exclusive, non-transferable license to use the materials for their intended purpose.

7. Limitation of Liability

7.1 No Guarantee of Employment: Recruty Ltd does not guarantee employment as a result of the Services.

7.2 Exclusion of Liability: Recruty Ltd shall not be liable for indirect, incidental, or consequential damages arising from the use of our Services.

8. Termination

8.1 Termination: by Either Party Either party may terminate the agreement with written notice if the other commits a material breach of these Terms.

8.2 Effects of Termination: Upon termination, the Client shall pay for all Services rendered up to the date of termination.

9. Governing Law and Jurisdiction These Terms shall be governed by the laws of England and Wales. Disputes shall be subject to the jurisdiction of English courts.

10. Amendments Recruty Ltd reserves the right to amend these Terms. Changes will be effective upon posting on our website or notifying the Client in writing.

11. Entire Agreement These Terms constitute the entire agreement and supersede prior agreements or representations.

PRIVACY POLICY

DATA HANDLING AGREEMENT

1. Data Collection and Usage Recruty Ltd will collect and use Client data solely for recruitment purposes, ensuring compliance with UK GDPR.

2. Confidentiality and Security All data will be securely stored and accessed only by authorized personnel.

3. Restrictions on Data Use Clients agree not to misuse or share proprietary materials provided by Recruty Ltd.

4. Termination of Agreement Upon termination, data will be securely destroyed or returned to the Client.

5. Liability Clients indemnify Recruty Ltd against misuse of data or unauthorized disclosures, barring gross negligence by Recruty Ltd.

6. Data Protection Policy In the event that a client or candidate manipulates Recruty Ltd, its staff members, or its processes, including but not limited to disputes over job placement outcomes, refunds, or Certificates of Sponsorship, the Company reserves the right to initiate legal action. This includes any form of blackmail, threats, harassment, or misbehavior towards the Company, its staff, or its reputation. Furthermore, should the client or candidate misuse or disclose proprietary information, staff personal data, or any content from the Company’s website or social media without explicit written consent, Recruty Ltd reserves the right to:

  • Seek compensation for reputational damage or personal harm caused to staff members or the Company.

  • Initiate legal proceedings to protect its interests and recover damages.

Clients and candidates are strictly prohibited from engaging in any conduct that harms the Company’s image, its personnel, or its services. Any violations will result in immediate termination of services and potential legal ramifications.

7. Governing Law This Agreement is governed by the laws of England and Wales.

REFUND POLICY

Recruty Ltd is committed to delivering quality recruitment services to all clients. However, refunds will be governed by the following conditions:

  1. No Refund for Services Rendered: Recruty Ltd shall not be liable to refund any fees paid for services already provided, including but not limited to CV writing, interview preparation, or job application assistance.

  2. Interviews:

    • Recruty Ltd will try to close up to 10 interview opportunities for the client. If the client fails to secure employment after these interviews, no refund shall be issued.

    • In case Recruty Ltd fails to provide any interview calls within 150 working days, a refund shall be issued after deducting administrative and registration fees.

  3. Client-Initiated Withdrawal:

    • If the client decides to withdraw from the process after receiving the first interview call, no refund shall be provided. Recruty Ltd will deduct 40% of the total fees as administrative charges.

    • Withdrawal during later stages shall incur the following deductions:

      • 40% during the interview phase.

      • 70% post-interview but prior to joining letter issuance.

      • 100% after the issuance of a joining letter.

  4. Client Misconduct or Non-Compliance:

    • No refund shall be issued if the client provides falsified or fraudulent documents.

    • Non-disclosure of pre-existing medical conditions impacting the recruitment process will result in forfeiture of fees.

  5. Changes in External Circumstances:

    • Recruty Ltd is not responsible for changes in government regulations or immigration policies. If the client decides to withdraw due to such changes, the refund policy outlined above shall apply.

  6. Failure to Pay Outstanding Fees:

    • If the client fails to clear outstanding fees at any stage, Recruty Ltd reserves the right to terminate services without any refund and initiate legal proceedings if necessary.
